The constitutional phrase “other high crimes and misdemeanors” has been central to the use of the impeachment power throughout our history, and yet it remains frustratingly unclear. To understand what impeachable offenses are and how the power has been used, it makes sense to consider why the impeachment power was included in the constitutional framework in the first place. What is the impeachment power for, what are impeachable offenses, and for what purposes should the Congress make use of this particular constitutional tool?
